7 years jail, rotan for violent outburst over parking offence

KUALA LUMPUR, 9 Jan 2018: 

A former dispatch rider was sentenced to seven years’ jail and three strokes of the cane by the Ampang sessions court today for voluntarily causing hurt to a female parking supervisor of Zoo Negara while robbing her of a mobile phone in September last year.

Judge Azrul Darus meted out the sentence on Wan Ahmad Kamil Wan Daud, 37, who is currently unemployed – after he changed his plea to guilty on the third day of the trial.

The court ordered Wan Ahmad Kamil to serve his sentence from the day he was arrested – 5 Sept 2017.

Wan Ahmad Kamil was charged with committing the offence on Koo Kah Lai, 29, at a parking area in front of the Finas building, Taman Melawati, Ampang Jaya, here, at 11.30am on 3 Sept 2017.

The charge under Section 394 of the Penal Code carries a jail term of up to 20 years with whipping or a fine, upon conviction.

According to the facts of the case – on the day of the incident, the victim was at the Zoo Negara parking lot and she saw the accused – who was wearing a safety vest – outside the Finas parking area.

The complainant then approached the accused upon seeing him instructing someone to park his car at the Finas parking lot – before telling Wan Ahmad Kamil that what he did was wrong and she would report the matter to Finas.

The accused, however, scolded the victim and told her not to interfere.

The victim then tried to take the accused’s photo with her mobile phone – but failed as the man snatched the phone and punched her on the right cheek, causing her to fall.

The victim then asked the accused to give her back the mobile phone, but he refused – and kicked the woman on her right thigh before fleeing with the phone.

In mitigation, the accused – who was unrepresented – pleaded for a light sentence on grounds that he had to support his unemployed wife, who was suffering from a nerve disorder, and three children.

Deputy public prosecutor Nadiah Malek Fauzie urged the court to impose a deterrent sentence, taking into account the violent act committed by the accused which had caused injuries to the victim.

In KUANTAN, a grass cutter was sentenced to seven years’ jail and three strokes of the cane by the sessions court for injuring his mother by assaulting her last Thursday.

In response, the accused pleaded: “I want to see my mother before I serve my sentence; I want to apologise to her.”

Before proceedings began, accused Mohd Rafi Ab Aziz, 25 – handcuffed and clad in a grey jacket – appeared to be looking out for someone as he was brought into the courtroom by policemen.

After the charge was read out to him, the accused – who was not represented – nodded to indicate he understood the charge and pleaded guilty.

According to the charge sheet, the accused had on Jan 4, about 5pm at a house in Bukit Sagu 1, here, voluntarily caused hurt to his mother Mea’ah Abd Majid, 64, by hitting her head with the metal shaft of a grass cutter.

As a result, the victim was injured on the right side of her head and received three stitches while being treated at Tengku Ampuan Afzan Hospital.

The accused was charged under Section 324 of the Penal Code, read together with Section 326A, which provides for a jail term of up to 10 years or a fine or whipping, or any two of the punishments.

Before judge Siti Aminah Ghazali made her decision, Mohd Rafi pleaded for a light sentence – saying he was suffering from hernia and had to support his mother.

However, deputy public prosecutor Haryati Abdullah asked for an appropriate sentence as a deterrent, as the victim is the accused’s natural mother and had needed three stitches for her injury from the incident.

“On the day of the incident, the accused had asked for money from his mother and when he was not given, he became furious and threw things at her but she managed to dodge the flying objects.

“Not satisfied, the accused picked up a grass cutter and hit his mother with its shaft. And I do not think the accused was fending for his mother as every month, he was asking for money from her.

 “Therefore, the accused should be given a heavy sentence, also as a deterrent to others,” said the DPP.

 After the proceeding, the accused repeatedly voiced his regret for his action to the court officials present and was teary-eyed when told that his mother could not be in court as she was unwell.
