6-months grace before fines for smoking at eateries

KUALA LUMPUR, 2 Jan 2018: 

The Health Ministry will use the educational approach and holistic explanations in the first six months of the smoking ban at eating premises and will only impose a penalty on errant smokers after that.

Minister Datuk Seri Dr Dzulkefly Ahmad said the move is the normal standard operating procedure (SOP) to enable the public to understand the policy better before any punishment was meted out.

The ministry would not immediately punish because the priority now is to create awareness among smokers not to light up in banned areas – to ensure the public is free from cigarette smoke pollutions.

‘’We are not here to punish, we want Malaysians to take care of their health, whether premises owner or citizens.

‘’We give a six-month campaign period to educate so no one is ignorant, after that there will be no more excuse,’’ he said after a walkabout to promote eateries as no smoking areas in Bandar Sri Permaisuri which was enforced nationwide from yesterday.

Dzulkefly said the ministry had 5,008 trained officers and Environmental Health assistant officers nationwide to monitor and issue verbal warnings to smokers or food outlet owners who failed to comply with the directive issued.

In the meantime, Dzulkefly also announced that following the walkabout the ministry planned to gazette more open areas such as laundries as no smoking areas in future.

‘’Just now, I had the opportunity to see public places such as laundry shops where some people who are waiting for their clothes to be cleaned will resort to smoking which will expose others to cigarette smoke.

‘’So, there is a possibility that from time to time we will increase the gazetting of public places as no smoking areas other than the nine places or food premises.’

On the seven individuals who filed for a judicial review to challenge the decision on the smoking ban at all eating premises, Dzulkefly said the ministry was ready to scrutinise the judicial review.

“They have channels to express their disagreement with us and they are free to do it. I have gone through their judicial review request, we are willing to talk to them or see them in court.”

The Johor State Health Department yesterday inspected 319 food premises and issued 22 warning notices on premises which failed to comply with the smoking ban.

State Health, Environment and Agriculture Committee chairman Dr Sahruddin Jamal said that as of 3pm, besides checking and issuing warning notices at eateries, a total of 957 pamphlets were also distributed regarding non-smoking areas and providing advice to individuals.

“It is hoped that people would reject the culture of smoking in public and more smokers would quit the habit,” he said in a statement.

Sahruddin said services to help smokers quit was provided at health clinics all over Johor and relevant information was available at http://jomquit.moh.gov.my.

He said the Johor State Health Department had also started a campaign to ban smoking in eateries since last month through the advocacy of the state government, local authorities, district offices, hawkers’ association and other traders as well as raising public awareness through social media and radio .

“Hence, we urge all parties to work together to make sure that these rules are complied with to ensure we have a smoke-free Johor.”
