Tan Chong Motor sued by bus firms

KUALA LUMPUR, 19 Aug 2017: 

Tan Chong Motor Holdings Bhd’s unit, Tan Chong Industrial Equipment Sdn Bhd (TCIE), has received writ of summons and statement of claim from solicitors acting for bus companies.

In a filing to Bursa Malaysia, Tan Chong Motor said the solicitors were acting for Transnasional Express Sdn Bhd, Plusliner Sdn Bhd, Syarikat Kenderaan Melayu Kelantan Bhd, Syarikat Rembau Tampin Sdn Bhd, Kenderaan Langkasuka Sdn Bhd, Konsortium Transnasional Bhd, and MHSB Properties Sdn Bhd.

It said the plaintiffs applied for injunctions to, among others:

  • restrain TCIE from repossessing and disposing of the vehicles the subject of a settlement agreement between the Plaintiffs and TCIE until disposal of the action;
  • restrain TCIE from entering into any dealing in relation to the land and a declaration pertaining to the value of the land of MHSB  is RM55.6 million;
  • restrain TCIE from taking any enforcement action under the settlement agreement between the plaintiffs and TCIE until disposal of the action; and
  • repay compensation from the acquisition of part of the land and the sum of RM22.6 million.

The injunction application is fixed for hearing in the High Court of Malaya on Wednesday Aug 23.

TCIE’s solicitors feel the action is without any legal basis and it has instructed its solicitors to file an application to strike out the action.
